Conneticut Federal Court Grants Certification of PSR Class

Our Comment:

Judge Janet Bond Arterton has granted conditional class certification in the case of Luann Ruggeri v. Boehringer Ingelheim Pharmaceuticals, Inc. This order validates our claims that pharmaceutical sales representatives are treated the same nationwide.  The court recognized that standardized procedures are prevalent in the industry and therefore, for the purposes of this case will treat them as one group.  The next step in the process will be to allow individuals to opt-in to the case under the rules of the Fair Labor Standards Act. 

The court in this ruling also dismissed the state law claims.  If individuals live in states with more favorable laws than under the FLSA will have tofile those claims separately.  Such examples include different methods of calculating damages, and/or longer statutes of limitation.  Please consult us by filling in the form to the right to inquire further.
